Clan Gunn Family Convention / Derbhfine petition 2012 - and its logical rejection
I have written on this subject many times in my blog - http://clangunn1.blogspot.co.uk/2012/02/clan-gunn-chief-needed.html is a good place to start. But the blog reflects events as they happened. The below is a summary -
In essence a small, self-chosen group of mainly Clan Gunn Societies hierarchy petitioned (without, as far as I am aware, any discussion in any Clan Gunn society) Lord Lyon (the Scottish court which decides on such matters) to convert the current Commander (a sort of an Honorary Chief until he dies, relinquishes the position or a Chief is found) into the Chief of the Clan Gunn, and that means his line forever. Now, I disagreed with this idea for many reasons but fundamentally I believed that the signatories to the petition misread the basis of these family conventions; Lord Lyon writes -
There are a number of circumstances in which it would seem appropriate to hold a Family Convention:
(1) Where a blood link to a past Chief or Head of Name is likely but is not conclusively proven and it is wished to propose a particular person in that situation to be recognised as Chief.
(2) Where the main line of descent from a past Chief has died out and it is wished to recognise the Representer of a cadet line as Chief.
(3) Where neither blood link to a past Chief nor Representer of a cadet line can be identified but it is wished to propose a particular person of the surname as Commander. It is generally desirable that such a Commander should live in Scotland

So, the first reason for calling a Family Convention idea does not apply as I am related to the 'Chief' - I prefer to view it as the Mckaimish line - bloodline (as is the Commander) - and I am aware of many others. My line is conclusively proven and can be easily conclusively legally proven. Given that point one should not apply as many people are known linked to this line, the idea that the a particular person to be accepted as Chief is just not applicable -- that leaves the second reason; to appoint a Representer of a cadet line as Chief. I have asked Lord Lyon a hypothetical question and the answer is Lord Lyon will always choose the senior line available. The Commander's line is not very senior; mine is more so.
The petitioners believed that point 1 applied as no-one had proved that they could be Chief so they could appoint who they liked. It is obviously significantly more awkward to prove one is the Head of a Clan as one has to prove all other lines are extinct but it is quite easy to prove one is descended from the Mckaimish line.
The petition was rejected as
'there has been an unexpected and significant flow of genealogical information sent to the Court of Lord Lyon from which it has become evident that there is in all probability clear and proveable lines of descent senior to that of the present Commander'.

In other words Lord Lyon accepted the idea that it is the question of who is the most senior representer of a cadet line which is the issue.

And it makes sense - logic says
1) 'Chief'.
2) If not a 'Chief', the person most closely related to a 'Chief'.
3) If no-one is related to a 'Chief' then consider if one wants to choose someone randomly to be 'Chief'.
I also know that the assumption underpinning the petition is wrong - namely that all Gunn genealogy is known - and so the petition should not have been made in the first place. Elsewhere on this site much new Gunn genealogy is shown.
It's worth noting Lord Lyon's role - as I understand it Lyon is legally only interested in the person who is after 'Chief arms', he is not interested in 'contested' family conventions as he does not, in my opinion, have the legal authority to make judgements in them --
"There is no instance in the registers of any judicial decision by Lyon in a disputed question of chief-ship or chieftainship. ...
"I agree with your Lordships that Lyon has no jurisdiction to entertain a substantive declarator of chief-ship of a Highland clan, or of chieftainship of a branch of a clan ...
Since the accession of Innes of Learney as Lyon in 1945, there have been three cases in Lyon's Court explicitly involving chief-ships. In only one case, the recent Gunn (1996) case was there a dispute. It took the form of two petitions filed at the same time for recognition to the un-differenced arms and the title of Chief. Lyon's decision is carefully worded, avoiding any mention of chief-ship, and merely rejecting one petition (on sound genealogical ground) and allowing the other petitioner to offer proof of his claim (see http://www.lyon-court.com/lordlyon/files/Gunn,%20Michael%20James%20-%20Interlocutor%20and%20Note.pdf) . The two other cases only involved a petition by an individual. Therefore, there has not been any suit or legal action (what the Lord Justice-Clerk calls "lis or contested process") involving a chiefship. Nor could there be, it seems to me: Lyon's pronouncements of chiefships have no legal value,

[1]From a November email 14.11.2009 we ‘have come to a firm conclusion that Marjory (or the shorthand, May) is the right way to refer to your ancestor, Marjory (Dunbar) Gunn. She is Marjory in the Watten Parish Register (Marriage) and Marjory in another Watten document …. Thereafter she is referred to as May (sons Donald and John Death registrations). Alexander Gunn (Braehour) also has her recorded as May Dunbar on his Genealogical tree-"May, daughter of Alexander Dunbar of Rowens". Rowens is about 7 kilometres south of Loch Watten about 1 kilometre to the west of the very secondary road north from West Clyth. Camster Burn is known also as Rowens Burn, being part of the Wick river basin, which also includes Loch Hempriggs. She has been referred to in some old documents as ‘of Hempriggs’. The Dunbar of Hempriggs family were very well known; see http://www.laird.org.uk/Caithness/Ackergill-Hempriggs.htm for details. Hempriggs means hemp ridge! But the Dunbars are well researched— http://www.fionamsinclair.co.uk/genealogy/Caithness/Hempriggs.htm --for example and she does not appear. Why? Illegitimate, perhaps? Too lowly a marriage? Both? Neither?

In essence a small, self-chosen group of mainly Clan Gunn Societies hierarchy petitioned (without, as far as I am aware, any discussion in any Clan Gunn society) Lord Lyon (the Scottish court which decides on such matters) to convert the current Commander (a sort of an Honorary Chief until he dies, relinquishes the position or a Chief is found) into the Chief of the Clan Gunn, and that means his line forever. Now, I disagreed with this idea for many reasons but fundamentally I believed that the signatories to the petition misread the basis of these family conventions; Lord Lyon writes -
There are a number of circumstances in which it would seem appropriate to hold a Family Convention:
(1) Where a blood link to a past Chief or Head of Name is likely but is not conclusively proven and it is wished to propose a particular person in that situation to be recognised as Chief.
(2) Where the main line of descent from a past Chief has died out and it is wished to recognise the Representer of a cadet line as Chief.
(3) Where neither blood link to a past Chief nor Representer of a cadet line can be identified but it is wished to propose a particular person of the surname as Commander. It is generally desirable that such a Commander should live in Scotland

So, the first reason for calling a Family Convention idea does not apply as I am related to the 'Chief' - I prefer to view it as the Mckaimish line - bloodline (as is the Commander) - and I am aware of many others. My line is conclusively proven and can be easily conclusively legally proven. Given that point one should not apply as many people are known linked to this line, the idea that the a particular person to be accepted as Chief is just not applicable -- that leaves the second reason; to appoint a Representer of a cadet line as Chief. I have asked Lord Lyon a hypothetical question and the answer is Lord Lyon will always choose the senior line available. The Commander's line is not very senior; mine is more so.
The petitioners believed that point 1 applied as no-one had proved that they could be Chief so they could appoint who they liked. It is obviously significantly more awkward to prove one is the Head of a Clan as one has to prove all other lines are extinct but it is quite easy to prove one is descended from the Mckaimish line.
The petition was rejected as
'there has been an unexpected and significant flow of genealogical information sent to the Court of Lord Lyon from which it has become evident that there is in all probability clear and proveable lines of descent senior to that of the present Commander'.

In other words Lord Lyon accepted the idea that it is the question of who is the most senior representer of a cadet line which is the issue.

And it makes sense - logic says
1) 'Chief'.
2) If not a 'Chief', the person most closely related to a 'Chief'.
3) If no-one is related to a 'Chief' then consider if one wants to choose someone randomly to be 'Chief'.
I also know that the assumption underpinning the petition is wrong - namely that all Gunn genealogy is known - and so the petition should not have been made in the first place. Elsewhere on this site much new Gunn genealogy is shown.
It's worth noting Lord Lyon's role - as I understand it Lyon is legally only interested in the person who is after 'Chief arms', he is not interested in 'contested' family conventions as he does not, in my opinion, have the legal authority to make judgements in them --
"There is no instance in the registers of any judicial decision by Lyon in a disputed question of chief-ship or chieftainship. ...
"I agree with your Lordships that Lyon has no jurisdiction to entertain a substantive declarator of chief-ship of a Highland clan, or of chieftainship of a branch of a clan ...
Since the accession of Innes of Learney as Lyon in 1945, there have been three cases in Lyon's Court explicitly involving chief-ships. In only one case, the recent Gunn (1996) case was there a dispute. It took the form of two petitions filed at the same time for recognition to the un-differenced arms and the title of Chief. Lyon's decision is carefully worded, avoiding any mention of chief-ship, and merely rejecting one petition (on sound genealogical ground) and allowing the other petitioner to offer proof of his claim (see http://www.lyon-court.com/lordlyon/files/Gunn,%20Michael%20James%20-%20Interlocutor%20and%20Note.pdf) . The two other cases only involved a petition by an individual. Therefore, there has not been any suit or legal action (what the Lord Justice-Clerk calls "lis or contested process") involving a chiefship. Nor could there be, it seems to me: Lyon's pronouncements of chiefships have no legal value,

[1]From a November email 14.11.2009 we ‘have come to a firm conclusion that Marjory (or the shorthand, May) is the right way to refer to your ancestor, Marjory (Dunbar) Gunn. She is Marjory in the Watten Parish Register (Marriage) and Marjory in another Watten document …. Thereafter she is referred to as May (sons Donald and John Death registrations). Alexander Gunn (Braehour) also has her recorded as May Dunbar on his Genealogical tree-"May, daughter of Alexander Dunbar of Rowens". Rowens is about 7 kilometres south of Loch Watten about 1 kilometre to the west of the very secondary road north from West Clyth. Camster Burn is known also as Rowens Burn, being part of the Wick river basin, which also includes Loch Hempriggs. She has been referred to in some old documents as ‘of Hempriggs’. The Dunbar of Hempriggs family were very well known; see http://www.laird.org.uk/Caithness/Ackergill-Hempriggs.htm for details. Hempriggs means hemp ridge! But the Dunbars are well researched— http://www.fionamsinclair.co.uk/genealogy/Caithness/Hempriggs.htm --for example and she does not appear. Why? Illegitimate, perhaps? Too lowly a marriage? Both? Neither?
